Terms of Service

Welcome to Lumy. By accessing or using our mobile application, website, and related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use the Service.

1. Acceptance of Terms

By creating an account or using the Service, you confirm that you are at least 13 years old — or older if the age of digital consent in your country is higher (for example, 16 in parts of the European Union) — and that you can enter into a legally binding agreement. If you are below the applicable age, you may not use the Service. If you use the Service on behalf of an organization, you represent that you are authorized to bind that organization.

2. Description of Service

Lumy is a family budget application that helps you track expenses, manage budgets, set savings goals, and gain AI-powered financial insights. The Service is available as a free tier and a paid Pro subscription. The Service is operated by its sole developer, based in the Republic of Moldova. 3. User Accounts

• You are responsible for maintaining the security of your account credentials.
• You must provide accurate and complete information when creating an account.
• You are solely responsible for all activity under your account.
• Notify us immediately at [email protected] if you suspect unauthorized access.

4. Subscriptions & Payments

Lumy offers a free tier and a Pro subscription. Pro subscriptions are billed through the Apple App Store or Google Play Store and are subject to their respective terms.

• Pro subscriptions renew automatically unless canceled at least 24 hours before the current period ends.
• You can manage or cancel your subscription through your device's app store settings.
• Refunds are handled by the respective app store according to their policies.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose.
• Attempt to reverse-engineer, decompile, or disassemble the app.
• Interfere with or disrupt the Service or its infrastructure.
• Share your account with others or create multiple accounts.
• Upload malicious content or attempt to exploit vulnerabilities.

6. Your Data

You retain ownership of all financial data and content you enter into Lumy. We do not claim any intellectual-property rights over your content. To operate the Service, you grant us a limited, non-exclusive, royalty-free licence to store, process, and transmit your content solely to provide the Service to you — for example, to sync and back up your data and to generate AI insights. This licence ends when you delete the content or your account, except for residual backup copies described in our Privacy Policy.

7. AI Features Disclaimer

Lumy's AI-powered features (insights, predictions, categorizations, and recommendations) are provided for informational purposes only and do not constitute financial, tax, legal, or investment advice. AI output may be inaccurate, incomplete, or out of date and must not be relied upon as a substitute for professional advice. You are solely responsible for any decision you make, and you should consult a qualified advisor before making significant financial decisions. To the maximum extent permitted by law, we disclaim liability for actions taken in reliance on AI-generated output.

8. Limitation of Liability

To the maximum extent permitted by law, Lumy and its operator shall not be liable for any indirect, incidental, special, punitive, or consequential damages arising from your use of the Service. The Service is provided "as is" and "as available" without warranties of any kind. To the extent liability cannot be excluded, our total aggregate liability arising out of or relating to the Service is limited to the greater of (a) the total amount you paid us for the Service in the twelve (12) months before the event giving rise to the claim, or (b) fifty US dollars (US$50). Nothing in these Terms limits liability that cannot be limited under applicable law.

9. Force Majeure

We are not liable for any failure or delay in performing our obligations where the failure or delay results from causes beyond our reasonable control, including acts of God, natural disasters, epidemics, war, terrorism, civil unrest, strikes or labour disputes, government action, and power, network, or third-party provider failures. Affected obligations are suspended for the duration of the event.

10. Export Compliance & Sanctions

You must comply with all applicable export-control and economic-sanctions laws. You represent that you are not located in, and will not use the Service from, a country or territory subject to comprehensive government sanctions, and that you are not listed on any government list of prohibited or restricted parties.

11. Service Availability

We strive to keep the Service available at all times but do not guarantee uninterrupted access. We may modify, suspend, or discontinue features with reasonable notice. Offline functionality ensures core features remain available without an internet connection.

12. Termination

You may stop using the Service and delete your account at any time. We reserve the right to suspend or terminate accounts that violate these Terms. Upon termination, you may export your data before deletion.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes through the app or via email. Continued use after changes constitutes acceptance of the updated Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Moldova, without regard to conflict of law provisions. The courts of Chișinău, Republic of Moldova shall have exclusive jurisdiction over any disputes arising from these Terms.
